Welcome to Valuables ("Valuables," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, products, digital content, services, applications, and any related features we provide.

By accessing our website, creating an account, purchasing a product, or using any portion of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our products or services.

These Terms constitute a legally binding agreement between you and Valuables.

Purchases made through Valuables may include physical products, digital content, or a combination of both.

Payments are processed by third-party payment providers. Valuables does not store your complete payment card information.

Digital content is licensed—not sold—to you for your personal, non-commercial use in accordance with these Terms.

If a purchase is refunded pursuant to our Refund & Dispute Policy, any digital account or digital access associated with that purchase may be suspended or terminated as part of the refund process.

Physical returns, cancellations, and refunds are governed by our Returns Policy, Cancellation Policy, and Refund & Dispute Policy.

All content made available through Valuables, including but not limited to activity cards, written content, digital activities, illustrations, artwork, graphics, logos, photographs, videos, audio recordings, software, website design, page layouts, text, downloadable materials, and all related intellectual property (collectively, the "Content") is owned by Valuables or its licensors and is protected by United States and international intellectual property laws.

Your purchase of a physical product or access to digital content does not transfer ownership of any intellectual property rights.

Except as expressly permitted by these Terms, you may not:

• •reproduce, copy, modify, distribute, publish, display, perform, transmit, sell, sublicense, lease, or otherwise exploit any Content;
• •create derivative works based upon our Content;

This license does not permit:

• •impersonate another individual or organization;
• •use our Content in connection with unlawful, abusive, or harmful conduct.

We reserve the right to investigate suspected violations and suspend or terminate accounts at our sole discretion.

You retain ownership of your User Content.

Valuables provides ideas, prompts, games, challenges, activities, and educational content intended to encourage meaningful family interaction.

Some activities may involve physical movement, running, jumping, climbing, lifting, balancing, rough-and-tumble play, outdoor environments, household tools or materials, sports equipment, or other activities that carry inherent risks.

Participation in any physical activity involves risks that cannot be completely eliminated, including the risk of falls, collisions, strains, sprains, cuts, bruises, broken bones, allergic reactions, property damage, illness, permanent disability, death, or other injuries.

You acknowledge that the types and severity of risks vary depending on the participants, environment, equipment, weather, health conditions, and countless other factors beyond Valuables' control.

By purchasing, accessing, or using any Valuables product or service, you knowingly and voluntarily assume all risks associated with participation in any activity suggested through our products or services.

You acknowledge that participation is voluntary and that you are solely responsible for deciding whether any activity should be attempted by you or any member of your family.

You further acknowledge that no activity can be made completely risk-free and that even properly supervised activities may result in injury or property damage.

Parents and legal guardians bear sole responsibility for all decisions regarding a child's participation in any Valuables activity.

You are solely responsible for determining:

• •whether an activity is appropriate for your child;
• •whether participants possess the maturity, judgment, physical ability, and health necessary to participate safely;
• •whether the environment is suitable;
• •whether weather conditions, lighting, terrain, traffic, water, animals, or other environmental conditions create additional risks;
• •whether equipment, toys, furniture, tools, household items, or materials used during an activity are safe and appropriate.

Valuables cannot evaluate the countless circumstances unique to every family, home, or activity location.

Children should be actively supervised by a responsible adult throughout participation in any Valuables activity.

Parents and guardians remain solely responsible for monitoring participants, enforcing appropriate safety rules, modifying activities when necessary, and stopping participation whenever conditions become unsafe.

Nothing provided by Valuables replaces the judgment, supervision, or decision-making responsibilities of a parent or legal guardian.

Before beginning any activity, you are solely responsible for evaluating the surrounding environment.

This includes inspecting the area for hazards, removing dangerous objects, ensuring adequate space, selecting appropriate safety equipment when applicable, and confirming that all materials and equipment are in safe working condition.

If conditions become unsafe at any time, the activity should be discontinued immediately.

You are solely responsible for determining whether each participant is physically and medically capable of safely participating in an activity.

Activities should not be attempted by anyone whose health, physical condition, injury, disability, fatigue, medication, or other circumstances make participation unsafe.

If pain, dizziness, illness, emotional distress, unsafe behavior, or other concerning conditions occur, participation should stop immediately.

Nothing provided by Valuables constitutes medical advice, physical training, occupational therapy, psychological counseling, or professional supervision.

Valuables provides activity suggestions, educational materials, and entertainment content only.

Valuables does not supervise activities, provide childcare services, monitor participants, inspect activity locations, evaluate equipment, or control how activities are performed.

Parents and legal guardians retain exclusive authority and responsibility to decide:

• •whether to participate;
• •when to participate;
• •where participation occurs;
• •how activities are modified;
• •whether an activity should be discontinued.

Any modifications, substitutions, omissions, or decisions regarding participation are made solely by the supervising adult.

Nothing contained within Valuables products or services should be interpreted as requiring, encouraging, or directing participation in any activity where doing so would be unsafe.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VALUABLES PROVIDES ITS WEBSITE, PRODUCTS, DIGITAL CONTENT, SERVICES, AND ACTIVITIES ON AN "AS IS" AND "AS AVAILABLE" BASIS.

VALUABLES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, OR THAT THE PRODUCTS OR SERVICES WILL MEET YOUR EXPECTATIONS.

WITHOUT LIMITING THE FOREGOING, VALUABLES DOES NOT WARRANT THAT:

• •any activity is appropriate for every participant or family;
• •participation will be safe under all circumstances;
• •activities will achieve any educational, developmental, behavioral, emotional, physical, parenting, or relationship outcome;
• •products or services will be uninterrupted, error-free, or available at all times;
• •defects will always be corrected;
• •content will always remain current or applicable to every situation.

You acknowledge that your use of Valuables is at your sole risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VALUABLES, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SUCCESSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR PRODUCTS OR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, VALUABLES SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR CLAIM ARISING FROM OR RELATED TO:

• •personal injury;
• •illness;
• •disability;
• •death;
• •emotional distress;
• •property damage;
• •loss of income;
• •lost profits;
• •loss of business opportunities;
• •loss of goodwill;
• •data loss;
• •interruption of service;
• •unauthorized access to accounts;

IN NO EVENT SHALL VALUABLES' TOTAL LIABILITY FOR ANY CLAIM EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO VALUABLES FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN THOSE JURISDICTIONS, THIS SECTION SHALL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Valuables, its owners, officers, employees, contractors, affiliates, licensors, successors, and agents from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• •your use of Valuables;
• •your violation of these Terms;
• •your misuse of any product or service;
• •your negligence or intentional misconduct;
• •injuries or damages arising from your participation in, supervision of, or modification of any activity;
• •your violation of any law or the rights of another person.

This obligation survives termination of these Terms.

Valuables reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate your account or access to any portion of our products or services if we reasonably believe you have:

• •violated these Terms;
• •engaged in fraud or attempted fraud;
• •abused our refund or chargeback processes;
• •infringed our intellectual property rights;
• •attempted unauthorized access to our systems;
• •interfered with the operation or security of our services;
• •engaged in conduct that may expose Valuables or its users to legal liability or security risks.

Termination of your account does not relieve you of obligations that accrued before termination, including payment obligations and provisions intended to survive termination.

Activities, instructions, recommendations, and other Content are developed based upon information available at the time they are created.

Valuables has no obligation to revise, update, replace, or remove any activity or Content because of changes in safety recommendations, product availability, industry standards, best practices, laws, regulations, or other developments.

Parents and legal guardians remain solely responsible for evaluating whether any activity remains appropriate, safe, and suitable for their particular circumstances at the time of participation.

Valuables may rely upon or integrate with third-party products and services, including payment processors, hosting providers, email providers, analytics providers, software platforms, and other service providers.

Your use of those third-party services may also be governed by their respective terms, privacy policies, and practices.

Valuables does not own or control third-party services and is not responsible for their availability, security, performance, accuracy, or actions.

We make no representations or warranties regarding any third-party service.

Interruptions, delays, or failures caused by third-party providers do not constitute a breach of these Terms by Valuables.

By creating an Account, purchasing a Product, or using our Services, you consent to receive communications from Valuables electronically.

These communications may include order confirmations, account notifications, security notices, policy updates, customer support communications, and other information relating to your Account or use of our Services.

Where required by applicable law, marketing communications will be sent only with your consent, and you may unsubscribe from marketing emails at any time.

Electronic communications satisfy any legal requirement that such communications be in writing.

Valuables shall not be liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including but not limited to:

• •natural disasters;
• •fires;
• •floods;
• •severe weather;
• •epidemics or pandemics;
• •labor disputes;
• •war;
• •terrorism;
• •civil unrest;
• •governmental actions;
• •utility failures;
• •internet outages;
• •cyberattacks;
• •failures of payment processors, hosting providers, or other third-party services.

Our obligations shall be suspended for the duration of the event to the extent performance is affected.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.

Unless otherwise required by applicable law, any legal action arising out of or relating to these Terms or your use of Valuables shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

You consent to the personal jurisdiction of those courts.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

The failure of Valuables to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision.

Any waiver must be in writing and signed by an authorized representative of Valuables.

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Valuables.

Valuables may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or other change in ownership or control.

These Terms shall bind and benefit each party and their respective successors and permitted assigns.

These Terms, together with our Privacy Policy, Returns Policy, Refund & Dispute Policy, Cancellation Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Valuables regarding your use of our Products and Services.

These Terms supersede all prior or contemporaneous communications, understandings, representations, or agreements relating to the same subject matter.

Valuables reserves the right to modify these Terms at any time.

When material changes are made, we will update the Effective Date at the top of these Terms and, where appropriate, provide additional notice through our website or your Account.

Your continued use of Valuables following the effective date of any revised Terms constitutes your acceptance of the updated Terms.

If you do not agree to the revised Terms, you must discontinue use of our Products and Services.
